IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
Conditions of Donation/Payment
These Terms of Donation/Payment set forth apply between you and the Happy Valley Elementary School Parent Club (“HVESPC”) with respect to your donation(s) or payment(s) for charitable event ticket purchases or yearbook(s) from HVESPC’S website. These Terms of Donation/Payment shall apply and may not be altered, supplemented, or amended by the use of any other document.
Donations/Payments made to this website are limited to customers who are at least 18 years of age and who are residents of either the United States of America or foreign countries supporting a minimum of 128 bit encryption. HVESPC’S will NOT accept donations/payments through this website from parties who are underage. By submitting your donation/payment through this website, you certify that you meet all of the requirements set forth in these Terms of Donation/Payment.
Credit/Debit Card Donations/Payments
Card donations/payments, limited to Visa, MasterCard and Discover Card ("Cards") are the only methods of payment that will be accepted through this website. All Payment Processor fees are paid by HVESPC.
Other Donation/Payment Methods
Please note that in addition to the website, donations/payments can be mailed to the Happy Valley Elementary School Parent Club at 3125 Branciforte Drive, Santa Cruz, CA 95065. HVESPC’S donations/payments may also be made Monday through Friday, between the hours of 8:30 am and 3:30 pm Pacific Time at the same address.
Donation/Payment Date
Your donation/payment is deemed received at the time you select the "Submit" button for a donation/payment if the transaction is confirmed via email.
Transaction Receipt
A donation/payment is not deemed made until we provide you with an email confirmation for such donation/payment. You can download or print a copy of the receipt page for your records.
Tax Deductibility
HVESPC’S Federal Tax Identification Number is 31-1777497. Please check with your tax advisor to determine if the gift or donation made through this website is tax deductible.
Your Representations
In addition to the representations in the Terms of Use, you represent to us that: (i) the information you provide to us will be accurate; (ii) you have the right to authorize us to obtain a donation/payment from the account designated in your instruction; and (iii) no other person's authorization or action is needed to approve our creation and processing of the donation/payment against your designated account.
Electronic Communications
In order to use our HVESPC’S website, you will need a working connection to the Internet from a personal computer device. Your Internet browser must support the Secure Sockets Layer (SSL), 128-bit encryption protocol. Mozilla Firefox 2.X or higher and Microsoft Internet Explorer 5.X or higher will support this feature. You also will need either a printer connected to your computer to print communications (e.g. receipt(s), emails, etc.) or sufficient hard drive space available to save the information. You must have your own Internet service provider (ISP), as we do not provide ISP services.
Refunds/Voids/Cancellations
All donations, charitable event ticket and yearbook purchases are final. HVESPC does not provide refunds for donations or tickets purchased online. Once you click/press the “Process Payment” button on the “Payment Review” page, you will not be able to void or cancel the online transaction.
Disclaimers; Limitation of Liability
In addition to the limitation of liability included in the Terms of Use, you agree that for any liability related to the donation/payment, HVESPC not is liable for any amount of damages above the aggregate dollar amount paid by you under this Terms of Donation/Payment.
Amendments/Termination
We reserve the right to amend (add to, delete or change) these Terms of Donation/Payment from time to time. By using this website to make a donation and/or purchase a charitable event ticket or yearbook, you agree with all such amendments.
Entire Agreement
This Terms of Donation/Payment, the Terms of Use, and the Privacy & Security Policy constitute the entire agreement between HVESPC and you.
By checking the "By checking the box above, I have fully read and accept the Terms of Donation/Payment." box on the “Terms of Donation/Payment” page, you are confirming that: (1) you agree to receive communications electronically; (2) your computer system meets the requirements set forth above; (3) you are able to access and print or store information presented at this website; and (4) you agree to this Terms of Donation/Payment, which will be deemed to supplement the Terms of Use and Privacy & Security Policy found elsewhere at this website.
